We
are thrilled with the enthusiasm shown toward the many creative products,
images and designs produced by EK Success Brands. They are designed with you in
mind for your use, your enjoyment, and most of all, for your personal
expression.
In
the interest of a creative industry and the pleasure that one gets in sharing
their crafting abilities with others, we are pleased to allow the following
limited license to use our copyrighted product designs. This policy is
specifically made for the purpose of creating craftworks for sale in limited
quantities in a local geographic location. The use of EK Success Brands’
designs and images is subject to the terms and conditions outlined below: The
following product lines are considered EK Success Brands’ designs: Jolee’s Boutique,
Sticko, EK Success, EK Tools, K&Company, Inkadinkado, Dimensions, PaintWorks, Perler, and Laliberi.

Prior to selling items bearing EK Success Brands’ designs, the Angel Policy
Permission Form must be filled out completely and returned to EK Success Brands
for approval.

Upon approval, EK Success Brands grants a royalty-free limited license to
create and sell items, projects, cards, scrapbook pages, stickers, shadowboxes,
etc., which contain EK Success Brands’ designs. Please note that no designs
of Licensors may be used. As this list is subject to change, please check with
Andrea Silva via email at asilva@eksuccess.com to determine if products you intend
to use are licensed designs.

A list of all EK Success Brands’ designs, including but not limited to, stamps,
stickers, shadowboxes, paper, needlecrafts, paint crafts, etc., which are
utilized, must be submitted to EK Success Brands on the attached Angel Policy
Permission Form. Items used must be listed by their unique item number.

Each craftwork item created for sale must be personally and individually made
by the selling artist and may not be reproduced or copied by any means,
including but not limited to, graphic, digital, electronic, or mechanical, and
photocopying. Mass production, assembly-line construction, production by
workers for hire, or syndication of handmade craftwork for sale is strictly
prohibited. Internet sales are strictly prohibited.

Wherever reasonable, each item bearing one or more of EK Success Brands’
designs must be marked with “One or more of the above designs are copyrighted
by EK SUCCESS, LTD.” in a reasonable size and location that gives reasonable
notice.

Copyrighted designs by EK Success Brands may not be altered in any manner,
including but not limited to, masking or overlaying portions in the overall
design. Any other alteration will be considered an infringement of copyright.

EK Success Brands’ designs and images may not be used for the purpose of
creating logos or company trademarks.

Quantities are limited to projects that are limited in scope, local in nature,
and otherwise do not constitute an ongoing business. Additionally, quantities
for commercial use are generally allowed if they are in the range of 50 items
per image. The
production of much larger numbers, and/or for an ongoing business, and/or for
an endeavor that is not local in nature,
is not permitted.
- The use of the images to be sold with a product to enhance a product or to
design a product on a regional or national level or for any mass production
requires a licensing agreement with EK Success Brands and the artist. (The
definition of mass produced is more than fifty copies of any one design reproduced
by mechanical means at a time or more than 200 copies per year of any one
design. Multi-person assembly-line work counts as mass production.)

Items may not be sold in a store or left in a store on consignment.

Persons participating in this Angel Policy may not sell, transfer or assign the
rights to EK Success Brands’ designs to anyone else.

Participants in this Angel Policy assume all liability for suitability of their
work and agree to indemnify EK Success Brands and its artists from disputes arising
from their work.

EK Success is a New York corporation. This Angel Policy will be governed by the
laws of the State of New York and the state and federal courts for New York County, New York will have exclusive jurisdiction over any proceeding arising
from this policy. Any failure by EK Success Brands to enforce any of its rights
will not constitute a waiver of such rights.
Effective
Date: May 14, 2004 EK Success Brands reserves the right to amend or change this
policy at any time. Revised June 21, 2012.
